FAQs
What is a local planning policy?
Local planning policies are prepared under a local planning scheme. Their primary role is to guide development, outline acceptable development standards, and provide direction on how Local Governments are will likely to exercise discretion.
Will the draft LPP4.1 – Unhosted Short-Term Rental Accommodation be applied retrospectively?
No. Any approved “Holiday Homes” will be able to continue to operate in accordance with their approval. However, should that approval be discontinued for a period of 12 months, a new application will be required to be made to the City and will be assessed under the provisions of the draft LPP4.1 if adopted.
When will the draft LPP4.1 become a seriously entertained document?
Once the consultation period has concluded, draft LPP4.1 will be considered 'seriously entertained' and will be given due regard in the consideration of any development applications received.
Can I still apply for Unhosted Short-term Rental Accommodation if I am in a proposed non-preferred area?
Yes. However any applications for new Unhosted Short-Term Rental Accommodation (STRA) in a non- preferred area will be considered against the provisions of draft LPP4.1 and are unlikely to be supported.
How can I found out if I need a Bushfire Evacuation Plan and who prepares these?
Any development applications for Unhosted STRA within a Bushfire Prone Area (BPA) will need to be accompanied by a Bushfire Evacuation Plan. To confirm if this applies to your property you can contact the City’s Planning team on 9781 0444 or view the Map of Bushfire Prone Areas available through the Department of Fire and Emergency Services.
A BEP should be prepared in accordance with the Western Australian Planning Commission “Bushfire Emergency Plan (BEP) Manual”.
What are the next steps for the scheme amendment?
The scheme amendment will be sent to the Western Australian Planning Commission (WAPC) for consent to advertise. Should this be granted, the community will have an opportunity to provide feedback.
Where can I find out further information on the changes to Unhosted Short-term Rental Accommodation?
Further information is available on the City’s website here.
