Consultation has concluded

Stage 2 of the Holiday Home Review is now complete.

At its meeting of 8 June Council resolved to commence Stage 2 of the Holiday Home Review. The purpose of this stage is to initiate amendments to the City’s Holiday Home Local Law 2012, which included the advertising of the following proposed changes:

  • Reducing the manager response time from 24 hours to 12 hours (relating to clauses 2.3, 2.6 and 3.4);
  • A review of penalties listed in Schedule 2.

A copy of the Council minutes can be obtained here (refer to Item 12.1).

The City invited comments on the proposed changes to the Local Law. Submissions closed on 5 August 2022.

    The City will monitor the impacts of implemented changes and community consultation will be undertaken in early 2023 to understand the implications of these changes on the broader community.

    As part of Stage 2 of the holiday home review, Council endorsed amendments to its local law on 21 September 2022. Once gazetted, the local law will be reviewed by the Joint Standing Committee on Delegated Legislation, which is a committee of State politicians from both houses of the Western Australian Parliament.

    Council also endorsed a policy to formalise the guiding principles which influence the registration conditions at its meeting of 21 September 2022.

    From 1 October 2022, as per adopted conditions of registration all holiday homes within the City of Busselton are required to display signage with a visible telephone number on which the Manager can be contacted as required.

    On 23 March 2022, Council resolved to adopt a staged approach for proposed changes to the regulation of holiday homes. To view the minutes of this meeting, please see the link here - 23rd March 2022 (Minutes)

    Stage 1 - complete: Introduced changes to the Conditions of Registration that apply to all approved Holiday Homes. It also introduced a Code of Conduct for occupants and their guests.

    Stage 2 - complete: Initiated amendments to the City’s Holiday Home Local Law and implemented Council Policy.

    Stage 3: Initiate changes to the planning provisions in the City’s Local Planning Scheme and Holiday Home Local Planning Policy. This will occur once uncertainties around the State Government’s position on Holiday Homes have been resolved.

    At its meeting of 9 June 2021 Council resolved to consider the implementation of five potential changes, subject to the outcomes of consultation. The proposed changes where presented to the community through a survey.
