The City of Busselton has received an application to amend the original Development Application and public comments are invited.
PROPERTY: Lot 2 (No. 30) Kent Street Busselton PROPOSED DEVELOPMENT: Amendment to Development approval - Change of Use - Restaurant/Cafe to Tavern
The proposal seeks amendments to the approved operating hours of the tavern. The existing conditions of approval restrict operating hours as follows:
Between 11am and 10pm, Monday to Sunday (inclusive), the maximum permissible patrons numbers in each area of the tavern site shall be as follows:
Within Building– 350 patrons;
Outside Building (Alfresco area) – 150 patrons; and
All areas of the tavern site including external areas are to be closed to the patrons between 12 midnight and 7am.
Between 10pm and 12 midnight, Monday to Saturday (inclusive) the maximum permissible the maximum permissible patrons numbers in each area of the tavern site shall be as follows:
Within Building– 350 patrons; and
Alfresco area not to be used.
The proposal seeks the following amendments:
Amended opening hours:
10am- 12pm Monday to Saturday (inclusive); and
10AM- 10PM on Sundays;
Maximum number of patrons in the areas of the premises as follows:
350 within the building;
115 within the eastern alfresco;
35 within the northern alfresco;
Alfresco areas permitted to be occupied during all approved operating hours subject to operation in accordance with the submitted noise management plan to achieve compliance with the Environmental (Noise) Regulations 1997.
