LOCAL PLANNING SCHEME AMENDMENT AVAILABLE FOR INSPECTION
LOCAL PLANNING SCHEME No. 21 AMENDMENT No. 61
Reference: AMD21/0061
Notice is hereby given that the local government of the City of Busselton has prepared the abovementioned Scheme Amendment for the purposes of:
Updating land uses and zoning table to align with the new ‘deemed’ and ‘model’ land uses classes introduced through the Planning and Development (Local Planning Schemes) Amendment (Short-Term Rental Accommodation) Regulations 2024.
Deleting superseded land use terms; and
Introducing ‘Special Control Area – Unhosted Short-Term Rental Accommodation Exclusion Area’ to prohibit unhosted short-term rental accommodation (i.e. - holiday homes) in identified areas of the City.
Under the proposed changes, properties within the Special Control Area (SCA) with an existing approval will be able to continue operating but new USTRA approvals will not be granted. The proposed SCA aligns with the recently adopted Local Planning Policy 4.1 – Unhosted Short-Term Rental Accommodation.
The consultation period closed on 9th July 2025.
At its meeting of 13 August 2025, Council resolved to adopt Amendment No. 61 and refer to the Western Australian Planning Commission (WAPC) for consideration and determination. A copy of the minutes are available in the document library.
