The City has reviewed its existing Activities in Thoroughfares and Public Places and Trading Local Law. As a result, several proposed changes have been made and are now open for public comment.

As part of this process, the Holiday Homes Local Law 2012 is also proposed to be repealed. This is due to the introduction of the State Government’s Short-Term Rental Accommodation Act 2024 (STRA Act) which came into effect in January 2025 and which overrides the Holiday Homes Local Law 2012, making it of no further effect.

  • The Council Agenda Item endorsing the public advertising;
  • The proposed new Activities in Thoroughfares and Public Places and Trading Local Law; and
  • A marked-up version highlighting the proposed changes from the existing local law.

CITY OF BUSSELTON

PROPOSED Activities in Thoroughfares and Public Places and Trading Local Law

Notice is hereby given under section 3.12(3) that the City of Busselton proposes to make the City of Busselton Activities in Thoroughfares and Public Places and Trading Local Law the purpose and effect of which is as follows:

Purpose: To make one law relating to activities in thoroughfares and trading in public places. The local law will also repeal the now redundant City of Busselton Holiday Homes Local Law 2012.

Effect: Some activities are prohibited, and some activities are permitted only under permit on thoroughfares and public places. Separately, the Holiday Homes Local Law 2012 will be formally repealed.

A copy of the local law may be inspected and a copy obtained at the City’s Administration Building, 2 Southern Drive, Busselton between the hours of 8.30am and 4.30pm Monday to Friday, on the City’s online engagement portal at yoursay.busselton.wa.gov.au/activities-in-thoroughfares-local-law-2025 and at any public library within the City of Busselton during normal opening hours.

Submissions about the proposed local law can be made via the City’s online engagement portal at yoursay.busselton.wa.gov.au/activities-in-thoroughfares-local-law-2025 or will be received by the Chief Executive Officer, Locked Bag 1, Busselton until no later than 7 January 2026.
