Consultation has concluded

As per the Environmental Protection (Noise) Regulations 1997, Macro Music have submitted a Regulation 19 Application (Reg 19) for music events to be held at 3 Oceans that do not comply with the sound levels as prescribed in the noise regulations. The purpose of the application, and any subsequent approval, is to provide Macro Music and the Metricup community with certainty regarding event noise levels for the period of the approval period.


Macro Music had a similar Reg 19 approval in place from 2017 – 2020. The event schedule, up to a maximum of 12 events per year included:

  • 2 MAJOR Events (Maximum 12 hours);
  • 8 MODERATE Events (Maximum 8 hours); and
  • 2 MINOR Events (Maximum 4 hours).


Events held during the previous Reg 19 included:

2017 - 2018: Summer Salt, Tash Sultana;

2018 - 2019: Passenger and Guests, Rufus Du Sol, Xavier Rudd;

2019 - 2020: Here Comes the Sun, Sugarloaf Rock.


The current Reg 19 application will again provide for up to a maximum of 12 events per year (depending on act availability) over a 3 year period which includes:

  • 2 MAJOR Events (Maximum 12 hours) with a sound curfew of 10:55pm;
  • 8 MODERATE Events (Maximum 8 hours) with a sound curfew of 10:55pm; and
  • 2 MINOR Events (Maximum 4 hours) with a sound curfew of 10:55pm.


As with the previous Reg 19 approval, the City will also include conditions such as specifying maximum noise levels, ongoing noise monitoring and a complaint response number being required for all events. COVID management will also be required in compliance with the Department of Health recommendations for all approved events.


Macro music have consulted with the surrounding community of 3 Oceans Wine Company through a Survey Invitation letter. The responses provided to the City suggest that the surrounding community are supportive of the new Regulation 19 application for 12 events, as outlined above.


The City’s Environmental Health Service has considered the application, the limited number of noise complaints received and the management of noise for previous events. We have also sought advice from Department of Water and Environmental Regulation Noise Branch as well as external noise consultants and in general are supportive of the application.


Under Regulation 19B(8)(iii) ‘the occupier of any noise sensitive premises within 1 km of the venue is to be provided the opportunity to make comment on the proposal. Submissions from residents will be used to support city officers to make a decision regarding the application.


Submissions will be open until 5 March 2021.
